CollabOps Terms of Use

These Terms of Use ("Terms") govern your access to and use of the services provided by CollabOps Co., Ltd. ("CollabOps," "we," "our," or "us"; also referred to as "(주)콜레봅스"). By creating an account or using our website, SaaS platform, or related DevOps tools ("Services"), you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility and Accounts

1.1 Eligibility.

The Services are intended for professional, organizational, and enterprise users. You must be at least the age of majority in your jurisdiction or authorized by your organization to use the Services.

1.2 Account Responsibility.

You are responsible for maintaining the confidentiality of your login credentials and all activities performed under your account.

1.3 Organizational Control.

If your account is part of an organization, workspace administrators may manage or access your account and associated data.

1.4 Unauthorized Access.

CollabOps may suspend or terminate your account if your activities violate these Terms, create security risks, or disrupt service stability.

2. Services

2.1 Service Description.

CollabOps provides a cloud-based DevOps platform that includes Git repository hosting, CI/CD automation, workspace management, issue and project tracking, log streaming, and AI-assisted development workflows. The Services are provided exclusively as a CollabOps-hosted SaaS offering.

2.2 Enterprise Installations.

Any enterprise deployment, private installation, or custom infrastructure setup is only provided through a separate written enterprise agreement. Self-hosted deployments are not provided by default.

2.3 No Warranty of Outcomes.

CollabOps does not guarantee improvement in software delivery, engineering productivity, or any specific technical results.

2.4 Third-Party Integrations.

The Services may integrate with external tools such as GitHub, GitLab, AWS, GCP, Azure, or Slack. CollabOps is not responsible for issues or failures caused by third-party services.

3. Subscriptions, Billing, and Payments

3.1 Subscription Model.

CollabOps offers paid subscription plans billed on a monthly or annual recurring basis. Subscriptions automatically renew unless canceled prior to the renewal date.

3.2 Payment Authorization.

By purchasing a plan, you authorize CollabOps and its payment processors to charge your selected payment method on a recurring basis.

3.3 Refund Policy.

Except where required by law, all payments are non-refundable. CollabOps may issue refunds or credits at its discretion (e.g., accidental double billing, service-level defects).

3.4 Regional Rights.

  • EU Residents: You may have a 14-day withdrawal right unless waived by immediate service access.
  • South Korea: Refunds may be provided according to the Electronic Commerce Act for defective or unavailable services.

4. Acceptable Use

4.1 Prohibited Activities.

You may not:

  • Reverse engineer, decompile, or probe the Services or infrastructure
  • Circumvent access restrictions or security features
  • Upload malware, harmful code, or use the Service for malicious purposes
  • Abuse APIs, overload the system, or generate abnormal automated traffic
  • Interfere with the stability or performance of the Services
  • Use the platform in violation of applicable laws or regulations

4.2 Enforcement.

CollabOps may suspend or disable accounts for Terms violations or harmful activity.

5. User Content and Data

5.1 User Content Definition.

"User Content" includes code, commits, configuration files, CI/CD pipelines, artifacts, logs, and any development material you upload to the platform.

5.2 Limited License for Operation.

You grant CollabOps a limited, non-exclusive license to process your User Content solely for:

  • providing the Services,
  • running CI/CD workflows,
  • rendering repository content,
  • maintaining platform stability and security,
  • anonymized or aggregated internal analytics.

5.3 No AI Training.

CollabOps does not use your private code, repositories, or identifiable User Content to train AI models.

5.4 Limited Access to Source Code.

CollabOps does not access, view, or analyze your source code except as required to operate the Service or address security issues.

6. AI Features

6.1 AI Outputs.

AI-assisted features may provide suggestions or automated insights. AI outputs may be inaccurate, incomplete, or unsuitable for production use.

6.2 No Guarantee.

CollabOps is not responsible for decisions made based on AI-generated recommendations.

6.3 External AI Providers.

Some AI features may involve third-party AI providers. User Content processed through AI features will not be used to train external models.

7. Security and Availability

7.1 Security.

CollabOps employs industry-standard security measures including encryption, access control, network isolation, and continuous monitoring.

7.2 Availability.

We aim to provide reliable service but do not guarantee uninterrupted operation. Outages may occur due to maintenance, incidents, or failures outside our control.

7.3 Customer Responsibility.

You remain responsible for maintaining local backups, securing your client-side environment, and ensuring that submitted data does not violate laws.

8. Intellectual Property

8.1 CollabOps IP.

All software, designs, infrastructure, and documentation remain the exclusive property of CollabOps.

8.2 Restrictions.

You may not copy, modify, reverse engineer, or create derivative works unless expressly permitted.

8.3 Open Source Components.

Some features may include open-source components subject to their respective licenses.

9. Termination and Cancellation

9.1 Your Rights.

You may cancel your subscription through your account settings. Cancellation stops future billing but does not entitle you to refunds unless required by law.

9.2 Our Rights.

CollabOps may suspend or terminate access at any time for violations, legal compliance, or security reasons.

9.3 Post-Termination Data.

After account termination, your data may be deleted or become inaccessible.

10. Disclaimers and Limitations of Liability

10.1 Disclaimer.

The Services are provided "as is" and "as available." CollabOps makes no warranties regarding accuracy, availability, or fitness for any purpose.

10.2 Limitation of Liability.

To the maximum extent permitted by law, CollabOps's total liability will not exceed the amounts paid by you in the 12 months preceding the claim.

10.3 Exclusions.

CollabOps is not liable for:

  • indirect, incidental, or consequential damages,
  • deployment failures or regression issues caused by CI/CD pipelines,
  • code loss, corrupted artifacts, or data exposure caused by user error,
  • downtime, delays, or disruptions from third-party tools or infrastructure.

11. Governing Law and Disputes

11.1 Governing Law.

These Terms are governed by the laws of the Republic of Korea.

11.2 Jurisdiction.

Disputes will be resolved by the Seoul Central District Court, to the exclusion of other courts.

12. Changes to Terms

CollabOps may revise these Terms at any time. Updated Terms will be posted on our website. Continued use of the Services constitutes acceptance of updates.
